This is an agreement (the \u201c<\/span>Agreement<\/span>\u201d) between you as a user of the Service (\u201c<\/span>you<\/span>\u201d, \u201c<\/span>your<\/span>\u201d) and\u00a0<\/span>Time Out Market Dubai Limited whose registered office is at 77 Wicklow Street, London, WC1X 9JY with registered number\u00a0<\/span>11878374<\/span><\/span>\u00a0(<\/span>\u201c<\/span>T<\/span>ime Out Market<\/span>\u201d, \u201c<\/span>we<\/span>\u201d) for access to wireless broadband services and features (the “<\/span>Service<\/span>“).<\/span><\/p>\r\n

This\u00a0<\/span>high speed<\/span>\u00a0internet access\u00a0<\/span>S<\/span>ervice is being provided by\u00a0<\/span>T<\/span>ime Out Market<\/span>\u00a0and its underlying service providers (the\u00a0<\/span>\u201c<\/span>Providers<\/span>\u201d<\/span>).\u00a0<\/span>The Service is provided by T<\/span>ime Out Market<\/span>\u00a0free of charge.\u00a0<\/span>As a condition for accessing this service, you must agree to the following terms and conditions of use (<\/span>\u201c<\/span>Terms of Use<\/span>\u201d<\/span>). If you do not agree to the Terms of Use you may not access or use the Service. If you click on accept at the bottom of these Terms of Use or otherwise use the Service, you will be deemed to have indicated your acceptance of these Terms of Use.<\/span><\/p>\r\n

Service Availability:<\/span><\/p>\r\n

An\u00a0<\/span>802.11b\/g and\/or Ethernet compatible computer, card, and\/or device<\/span><\/span>(“<\/span>Unit<\/span>“) are required to enable you to use the Service to operate. You are responsible for ensuring the compatibility of your Unit with the Service. The availability and performance of the Service is subject to all memory, storage and other limitations in the Unit. The Service is available to your Unit only when it is within the operating range of our system and\/or directly connected. Service is subject to availability,\u00a0<\/span>and Time Out Market<\/span><\/span>does not warrant that access to or use of the Service will be uninterrupted or error free. The Service may be unavailable at times (including due to emergencies, collocation failures, transmission and equipment limitations, or maintenance and repair, and any other reason beyond\u00a0<\/span>Time Out Market\u2019s\u00a0<\/span>reasonable control) and may be interrupted, refused, limited, or curtailed. We are not responsible for data, messages or pages that you may lose or that become misdirected because of interruptions or performance issues with the Service or wireless communications networks generally. We may impose usage or Service limits, suspend the Service, or block certain kinds of usage\u00a0<\/span>at<\/span>\u00a0our sole discretion to protect users, our business or the public generally, or if you are in breach of any term of the Agreement. Network speed is no indication of the speed at which your Unit or the Service sends or receives data. Actual network speed will vary based on unit configuration, compression and network congestion.<\/span><\/p>\r\n

Security<\/span><\/p>\r\n

You expressly acknowledge and agree that there are significant security, privacy and confidentiality risks inherent in accessing or transmitting information through the internet, whether the connection to the internet is facilitated through wired or wireless technology. These security issues range from interception of transmissions, loss of data, or the introduction of viruses or other programs that can damage your computer or network.<\/span><\/p>\r\n

ACCORDINGLY, YOU AGREE THAT\u00a0<\/span>NEITHER TIME OUT MARKET OR\u00a0<\/span>THE<\/span><\/span>PROVIDERS SHALL BE LIABLE FOR ANY INTERCEPTION OF TRANSMISSIONS, LOSS OF DATA, FILE CORRUPTION, HACKING OR DAMAGE TO YOUR COMPUTER OR NETWORK THAT RESULTS FROM THE TRANSMISSION OR DOWNLOAD OF INFORMATION OR MATERIALS THROUGH THE SERVICE.<\/span><\/p>\r\n

Restrictions on Use<\/span><\/p>\r\n

You agree not to use the Service to:<\/span><\/p>\r\n

a) resell any aspect of the Service, whether for profit or otherwise, or to authorise or permit any other individual or entity to use the Service<\/span>;<\/span><\/p>\r\n\r\n<\/div>\r\n<\/div>\r\n

d) h<\/span>arm, or attempt to harm, minors in any way;<\/span><\/p>\r\n

e) i<\/span>mpersonate any person or entity or falsely sate or otherwise misrepresent your affiliation with a person or entity; forge headers or otherwise manipulate identifiers in order to disguise the origin of any material transmitted through the Service;<\/span><\/p>\r\n

f) t<\/span>ransmit any material that you do not have the right to make available under any law<\/span><\/p>\r\n

g) t<\/span>ransmit any material that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;<\/span><\/p>\r\n

h) t<\/span>ransmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes or any other form of solicitation;<\/span><\/p>\r\n

i) t<\/span>ransmit any material that contains software\u00a0<\/span>viruses<\/span>\u00a0or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunication equipment;<\/span><\/p>\r\n

j) t<\/span>o make any username and password supplied by or on behalf of\u00a0<\/span>Time Out Market\u00a0<\/span>available publicly or to share them with anyone<\/span>; and<\/span><\/p>\r\n

k) u<\/span>se the services for excessively\u00a0<\/span>high-volume<\/span>\u00a0data transfers<\/span>.<\/span><\/p>\r\n

DISCLAIMER OF WARRANTIES<\/span><\/p>\r\n
